Copyright ownership has several rights that are associated with it. The U.S. copyright statute allows limited copying of copyrighted materials, without permission, for the purpose of teaching, including multiple copies for classroom use, scholarship or research under the fair use doctrine. Fair use has been defined as the privilege in others than the owner of a copyright to use the copyrighted material in a reasonable manner without his consent, notwithstanding the monopoly granted to the owner. “The fair use doctrine is an equitable rule of reason, which permits courts to avoid rigid application of the copyright statute when, on occasion, it would stifle the very creativity which that law is designed to foster. The question of the fairness of the use of a copyrighted work is partially factual, and partially legal. In any event, courts must make a case-by-case determination as to whether a particular use is fair” (Spalding).
The distinct difference in fair use and copyright infringement are very different. With technology, being able to scan any two-dimensional work, such as a book or illustration, into digital form and, from this digital version, create an exact copy that can be disseminated onto the Internet, there is no fair use in doing this. The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material. Another area that is being widely abused is in software copyright infringement.
